  • Court Claim, completing the forms.

    Hi, I am claiming for unpaid wages and am having to go to the small claims court. This has been ongoing since Juth ly/August last year. I offered (and was accepted) a payment plan of X amount per week. Varying amounts where paid over a period, stopping on 16th December. The company owner has since ignored any attempts to pay me.

    I am confused (it doesnt take much) as to how to complete the court forms, mainly the difference between, The Details of claim, and the Particulars.
    Any help gratefully received.

      The particulars of the claim: How why and how much.

      I take it your are an employee of a company?

      So: The claimant claims the sum of £xxxxx,xx being wages due and payable by the defendant under an agreement with the defendant and arising from employment in the period from date to date.

      Despite many requests the defendant has not paid the wages due.
      The NI form show boxes for court fees ( variable depending on amount claimed.

      I'm presuming the matter is suitable for small claims i.e. less than £10K?
      Was the payment plan arrangement verbal or written?

        I was employed by the company but I left as I wasnt getting paid, I have pay slips for what is owed, and texts and emails agreeing the payment plan, do I need to "show" these on the N1 form or just make reference to them.

          No need to mention on the N1 if this gets to it these can be used in your witness statement and disclosed at that stage.
